Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Custody

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was held in federal detention.

In her decision, the court pointed out that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "for now."

The legal proceedings involve disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.
